Our Real Estate Dispute team have acted for:

  • a pension fund in relation to a neighbouring development on Cannon Street in London to assert and protect the client’s building’s rights of light. The neighbouring development’s acquisition and construction costs are circa £250- 300 million;

  • an Isle of Man based Trust in relation to a neighbouring development in London W1 to assert and protect the client’s building’s rights of light. The neighbouring development’s acquisition and construction costs are circa £80-100 million;

  • a Guernsey Trust and Cypriot beneficial owner in relation to residential Party Wall Dispute in Central London with properties valued at circa £6-8 million pound each;   a major development company in relation to rights of light advice over ½ million square feet of land and the rights of the surrounding buildings for a site with redevelopment budget of circa £150 million; and

  • an agent in relation to introductory commission due upon an acquisition by a major property fund for £60 million.

Recent Cases

  • Defence of a claim under a Sale and Purchase Agreement for the sum of €1.6m with related counterclaims brought in this jurisdiction and in Germany for the sum of €60m approximately. This claim concerns detailed interpretation of the German Civil Code and is still ongoing.

  • Successful alternative dispute resolution in Ireland of a dispute with alleged losses to the value of €100k allegedly flowing from the non-performance of a machine supplied by our client to an Irish company.

  • Successful mediation for a Dutch client in London of a dispute of a value of €3.5m for alleged losses flowing from the non-performance of a machine line supplied by our client to an Irish company.

  • Investigation and referral of a complaint to the Jersey Financial Services Commission of the conduct of an individual being a Registered Person under the Financial Services (Jersey) Law 1998.

  • Enforcement of judgments in European and non-European countries (Turkey and Cyprus).

  • Assisted in defence of an action taken in a Court in France against a British company regarding goods delivered.

  • Numerous debt collection claims in Ireland and Scotland.

  • Peripheral advice on an action for personal injury taken against clients in USA and in Ireland.

  • Acting for a leading horse racing website in a dispute with a website designer over the intellectual property rights in the website design. This claim was settled by consent.

  • Acting for a local stone merchant in its claim against a competitor for trade mark and registered design infringement.

  • Acting for the vendors of a business pursuing sums due to them from the purchaser’s guarantor under a deed supplemental to the side agreement. An agreement by consent was negotiated between the parties in full and final settlement of the vendor’s claim.

  • Acting for the Trustee in Bankruptcy in his application for a declaration that the transfer of the matrimonial home from the bankrupt to his wife was a transaction at an undervalue pursuant to Section 339 of the Insolvency Act 1986.
    The case involved researching the various and complex property transactions undertaken by the bankrupt in the 5 years prior to the Bankruptcy Order being made. An agreement by consent was negotiated in satisfaction of the Trustee in Bankruptcy’s claim.
